  1. How telemarketers handle after-hours text messages and

  2. How voice providers manage robocall prevention

First, the Ecommerce Innovation Alliance wants the FCC to clarify whether consumers who opt in to telemarketing texts can still claim TCPA damages if messages arrive outside the 8 AM–9 PM window. They’re also pushing for a rule that assumes area codes reflect a consumer’s actual location, making it easier for businesses to comply.

Meanwhile, voice providers are pushing back on a new $11,000-per-violation fine for failing to block illegal robocalls. A $4.5 million fine against Telnyx has alarmed the VON Coalition and the Cloud Communications Alliance, who argue the FCC is shifting from "flexibility" in compliance to strict liability without clear guidelines.

Both issues are now open for public comment, and the stakes are high.
